"User" refers to any person accessing or using our services, whether as a Client or Candidate.
3. Use of Services
3.1 Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use our services. By using our services, you represent and warrant that you meet these requirements.
3.2 Account Registration
To access certain features, you may need to create an account. You agree to:
Provide accurate, current, and complete information
Maintain and update your information as needed

Notify us immediately of any unauthorized access

4.2 Client Responsibilities
Clients agree to:
Provide accurate job descriptions and requirements
Comply with all applicable employment laws
Provide a safe and lawful work environment
Pay invoices according to agreed terms
Not directly hire candidates without proper authorization
Cooperate in good faith throughout the placement process
4.3 Fees and Payment
Payment terms, including fees, rates, and invoicing procedures, will be specified in individual service agreements. Late payments may incur additional charges and interest as permitted by law.
5. Terms for Candidates
5.1 Application and Placement
By submitting your information or applying for positions through our platform, you:
Authorize us to share your information with potential employers
Represent that all information provided is accurate and truthful
Agree to background checks and verification as required
Understand that we do not guarantee job placement
Agree to communicate honestly about your employment status
5.2 Employment Relationship
Depending on the placement type, you may be employed by Creative Chemistry Works, the client organization, or engaged as an independent contractor. Specific terms will be outlined in your employment or engagement agreement.
5.3 Professional Conduct
Candidates agree to maintain professional standards, comply with client policies, and represent Creative Chemistry Works positively during all engagements.
6. Intellectual Property Rights
All content, features, and functionality on our platform, including but not limited to text, graphics, logos, software, and design, are owned by Creative Chemistry Works and protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use our services for their intended purpose. You may not:
Copy, modify, or distribute our content without permission
Use our trademarks or branding without authorization
Reverse engineer or attempt to extract source code
Create derivative works based on our platform
7. Privacy and Data Protection

8. Disclaimers and Limitations
8.1 No Guarantees

Successful placement for candidates
Perfect matches for client positions
Uninterrupted or error-free platform operation
Specific outcomes from our services
8.2 Service "As Is"
Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.3 Limitation of Liability
To the maximum extent permitted by law, Creative Chemistry Works shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you for our services in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Creative Chemistry Works, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services, violation of these Terms, or infringement of any rights of another party.
10. Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without cause or notice, including for violation of these Terms. You may also terminate your account at any time by contacting us.
Upon termination, your right to use our services will immediately cease. Provisions that by their nature should survive termination will remain in effect, including ownership provisions, warranty disclaimers, and limitations of liability.
11. Dispute Resolution
11.1 Informal Resolution
If you have a dispute with us, you agree to first contact us and attempt to resolve the dispute informally by sending a written notice to legal@creativechemistry.work
11.2 Arbitration
If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
11.3 Class Action Waiver
You agree that disputes will be resolved on an individual basis and waive your right to participate in class actions or class-wide arbitration, except where prohibited by law.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in the United States.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and Creative Chemistry Works regarding our services and supersede all prior agreements and understandings.
